Based on a careful risk assessment and its regular evaluation, Penz crane has concluded that there is no specific risk with regard to personal data. For this reason, Penz crane GmbH has currently not appointed a Data Protection Officer pursuant to the GDPR.

It is particularly important to us to protect all personal data you entrust to us and to store it securely. In this document you will find more information on how we use and process your personal data.

3. Purpose limitation, legal basis, storage period and data recipients

3.1

On the website of Penz crane GmbH, www.penz-crane.com and www.penz-crane.at, no personal data is collected, recorded or displayed, with the exception of the items listed in sections 3.2 and 3.3.

3.2

The following personal data is displayed on our website:

3.2.1 Name and function of our employees
3.2.2 Contact details of our sales and service partners, including any contact persons and their contact details
3.2.3 Short reports in the “News” and “Trade Fairs” sections which may, among other things, show persons and/or contain personal data
3.2.4 Photos in the image gallery which may, among other things, show persons and/or contain personal data

We require the personal data listed above for customer service purposes and for advertising purposes. The data is displayed and stored for these purposes; however, no personal data is collected via the website.

The legal bases for displaying personal data are, on the one hand, legitimate interests (e.g. customer service/service) and the performance of our legal and/or contractual obligations (e.g. spare parts supply, documentation, handling warranty and guarantee matters) and, on the other hand, your explicit consent (e.g. cookies, marketing-related displays).

Except for the above-mentioned data, no personal data of third parties is collected, displayed or processed on our website.

We process your personal data (as described above) to the extent necessary for the entire duration of the business relationship (from initiation, processing through to termination of a contract) and beyond that in accordance with statutory retention and documentation obligations, which arise in particular from the Austrian Commercial Code (UGB) and the Federal Fiscal Code (BAO), as well as until the conclusion of any legal dispute, ongoing warranty and guarantee periods, etc.

In the course of operating our website, we commission IT service providers for the general maintenance of our IT network as well as for web hosting and the maintenance and design of our website. Some of these tasks are also carried out by our own employees. Both external service providers and internal employees may, in the course of their activities, gain access to your personal data if they require the data to perform their respective services.
All external service providers and internal employees have undertaken to comply with the applicable data protection provisions vis-à-vis us. Data processing agreements pursuant to Art. 28 GDPR have been concluded (external service providers) and technical/organizational measures have been implemented (internal employees). In such a case, the data stored about you up to that point will be deleted. The withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent up to the time of withdrawal.

Our data protection manager uses technical and organizational security measures to protect stored personal data against accidental or intentional manipulation, loss or destruction and against access by unauthorized persons. Our security measures are continuously improved in line with technological developments.

You have the right at any time to obtain information from the controller (data protection manager, contact details above) about the personal data concerned. Insofar as there is no statutory retention obligation, you have the right to deletion of this data and to object to processing. Furthermore, you have the right to rectification, restriction of processing, data portability and to lodge a complaint with the Austrian Data Protection Authority (Wickenburggasse 8-10, 1080 Vienna, e-mail: dsb@dsb.gv.at).
